SC holds supremacy, jurisdiction over military courts: Justice Hani

ISLAMABAD – The honorable judge of Supreme Court of Pakistan had made a very important observation according to which the highest court of country possesses the supremacy and jurisdiction over any military court convened in Pakistan.

According to the observation made by Justice Amir Hani Muslim, the Supreme Court still has the jurisdiction because the appeal against the final order will to it.

Justice Hani was heading the two member bench which was hearing a case on law and order situation in Balochistan. During the hearing, the chairman of an activist group named Voice of Baloch Missing Persons, Nasrullah Baloch, informed the honorable court that relatives of missing persons were worried for not being able to access the military court’s trial of two army officers involved in alleged illegal abductions.

Justice Hani, however, held the view that trial in military court is just like a trial before Anti-Terrorism Court (ATC) where the appeal ultimately reaches the Supreme Court.


The court had been informed on Tuesday that the government wanted two serving military officers who had returned to their units after serving in the Frontier Corps (FC) in Balochistan to be tried under the Pakistan Army Act of 1952 on charges of illegally picking up Baloch people.
