SC gets five names for panel to initiate treason case against Musharraf | PakistanTribeISLAMABAD – The Supreme Court of Pakistan has received names of five judges from high courts for constitution of a special court to initiate the high treason case against former dictator president general (retd) Pervez Musharraf.

Chief Justice Iftikhar Muhammad Chaudhry on Monday summoned the names from chief justices of high courts. The names include Justice Yawar Ali, Justice Noorul Haq Qureshi, Justice Tahira Safdar, Justice Yahya Afridi and Justice Faisal Arab.

Registrar Supreme Court on the direction of the Chief Justice has sent these names to Secretary Law and Justice for nomination of three judges including a head and other members of the trial court from five names.

The Peshawar High Court (PHC) has proposed the name of Justice Yahya Afridi, the Islamabad High Court Justice Noorul Haq Qureshi, Sindh High Court Justice Faisal Arab, Lahore High Court has proposed the name of Justice Yawar Ali and Balochistan High Court has proposed the name of Justice Tahira Safdar for the special court.

All the five high courts have nominated one judge each and forwarded them to the apex court registrar with service profile. The Secretary Law has decided to submit the names of the judges to Prime Minister Nawaz Sharif, claimed a private TV channel.

Chief Justice Iftikhar Muhammad Chaudhry had asked the high courts to forward the names of judges after the government requested the Supreme Court to nominate three judges of the higher judiciary for the special court to initiate the trial of high treason against former president under Article 6 for subverting the Constitution while imposing the emergency and Provisional Constitutional Order (PCO) on November 3, 2007.

The chief justice had directed that nomination may reach the Supreme Court on Tuesday.

In past, military dictators breached the constitution so many times and later the issues were thrown to winds but this time history has recorded new pattern in the country.

Newly-elected government of PML-N has become a plaintiff while the man who ruled over the country more than nine years has become an accused.

Having direction from the Interior Ministry, the Ministry of Law had raised the issue in the apex court for trial of former president Pervez Musharraf and written a letter to the Supreme Court in this regard.

According to letter, the government has decided to form a special court comprising three judges of High Courts in Islamabad.
