ISLAMABAD – Supreme Court of Pakistan rejects the appeal of two serving military soldiers with the comment that the decisions of Military Courts are not challenge-able in Supreme Courts, PakistanTribe reported.
Two serving soldiers who were identified as Mushtaq and Mukarram Hussain had challenged the decision of Military court about death penalty. Supreme court, while rejecting their petition, commented that the decisions of Military courts can not be challenged in civil courts.
“Persons serving in Armed forces are treated with different laws,” the court said.
Earlier the petition was filed in high court but high court had rejected the petition saying that the case was above its jurisdiction. Later 2-member bench of supreme court led by Justice Ameer Hani Muslim while hearing the case said that the decision of Military court will be left ‘stand-still’.
According to ‘Online’, Soldier Mushtaq and L/NK Mukarram Hussain were charged over murder of their own companion at Siachin Front in 2004.
