LAHORE: The 21st Constitutional Amendment and the Army Act have been challenged in the Lahore Registry of the Supreme Court of Pakistan immediate after the approval of President.

The petition, filed by Barrister Zafarullah, states that the powers of the judiciary and the executive cannot be merged whereas the constitution does not allow legislation which is against the basic human rights.

Earlier, After the official approval of President of Pakistan the 21st amendment of constitution provided legal room for establishment of Military Courts.

PakistanTribe received reports that President of Pakistan has signed the bill about 21st amendment in the constitution duly approved by National Assembly last day.

This signature of bill have legalized the decision of establishment of Military courts.

Earlier the National Assembly on Tuesday has already approved the 21st Constitutional Amendment and Pakistan Army (Amendment) Bill 2015, unopposed as 247 members voted in favor of the laws which will provide constitutional cover to special courts for the trial of terrorism suspects.

The amendments in the constitution and the Army Act were passed by both houses of theParliament on Tuesday. Jamiat Ulema-e-Islam – Fazl (JUI-F), Jamaat-e-Islami (JI) and President of Awami Muslim League (AML) Shaikh Rasheed Ahmed did not take part in the voting.

The political parties of the country, in a multi-party moot, had agreed to make amendments in the constitution to provide legal cover to the formation of military courts in the country.
