Supreme Court moved against Army chief and CJCSC appointments | PakistanTribeISALAMABD – The Supreme Court has been moved against appointment of Chief of Army Staff (COAS) and Chairman Joint Chiefs of Staff Committee (CJCSC), reported.

The petitioner, Shahid Orakzai has requested the court to issue a stay order against the retirement of General Haroon Aslam who has been superseded by these appointments.

The petitioner has contended that an army official cannot leave his post during a war and an official laving his post on personal request has violated the oath of Pakistan Army.

The petitioner informed the court that officials of defence ministry have not presented the facts before Prime Minister Nawaz Sharif, so the court should summon both lists from secretary defence.

Shahid Orakzai has raised several questions including that whether President is bound to appoint army officers on same day.

Another question is that a person who is not in-eligible for post of CJCSC can be appointed as COAS?

The petitioner further raised the question that whether apex court can nullify these appointments? And whether lieutenant of Pak Army can supersede Naval admiral and Air Chief.

However, petitioner has said that he is not claiming the answers of these questions raised in the petition but he has raised these questions to prove the irregularities in appointments.

The petitioner has given example that Judicial Commission proposes single name for appointment of a judge in higher judiciary while prime minister is bound to give three names to opposition leader and on disagreement between both leaders six names can come.

The petitioner on Saturday filed its petition in apex court.
